WASHINGTON – For the first time in a decade, Democrats have gained unified control of Congress and the White House, using the opportunity to enforce an ambitious agenda of strong labor laws, expanded health care and infrastructure, climate change and packaging packages.
Yet the fate of that agenda – and any legislation passed in Congress – involves a rule in the Senate that requires a majority vote of 0 votes to end the debate before a bill can be passed.
Filibuster, once an obscure process, is increasingly used to hold the priorities of the majority coalition, especially on issues related to race and civil rights. While senators were in their most troubling position, most parties have made filibuster exceptions for key areas of the legislature, including executive and judicial appointments.
Now that the 50-50 split in the Senate has balanced the Democrats ’priorities, many in the party have called on the Senate to repeal the practice altogether.
Senator Dick Durbin, D-Ilin, the Senate’s second-highest-ranking Democrat, said in a one-floor speech in March that “Philibuster is still mocking American democracy.”
“Philibuster is still being abused by some senators to stop legislation immediately and has the support of a strong majority of the American people,” he argued.
Even President Joe Biden, a longtime senator, reluctantly expressed the practice for reform, once expecting senators to often speak on the floor to delay legislation for hours.
